MAGA's increasingly dangerous attacks on due process
"There's no due process if you come here illegally because you violated the law, period!"
These aren't the words of some fringe extremist who has no understanding of the law. They're from Republican Representative Victoria Spartz of Indiana, who is herself an immigrant from Ukraine.
The town hall crowd she spoke in front of erupted in boos because what Spartz said is blatantly unconstitutional and incredibly dangerous.
Due process is a fundamental right guaranteed by our Constitution to every person on American soil. The Fifth Amendment doesn't limit due process to citizens; it explicitly protects "persons."
This is a distinction the Supreme Court has repeatedly upheld. It is NOT in question.
Even the late conservative Justice Antonin Scalia once wrote, "It is well established that the Fifth Amendment entitles aliens to due process of law in deportation proceedings."
Yet Tom Homan, Trump's "border czar," recently sneered at the concept of due process during an ABC interview, illustrating a broader trend of MAGA's determination to undermine the very foundation of the rule of law.
The Trump administration also admitted in court that it made an "administrative error" in sending a law-compliant Maryland father, Kilmar Abrego Garcia, to a Salvadoran prison, claiming they aren't able to bring him back.
Thankfully, on April 4, a federal Judge ordered the administration to arrange for the man's return to the United States.
Many MAGA supporters believe Trump’s policies will always spare them or their loved ones.
But as we're seeing, no one is immune.

I am stunned at how easily Trump has made ignoring the rule of law seem like the right thing to do when we are dealing with the "border crisis" or "the terrible people that other countries are sending here." Is this a question of education or morality - or both?
